2. Scope and Purpose
The Service is intended to assist business clients with account creation, onboarding, and ongoing verification processes. It supports use cases such as user registration, password recovery, two-factor authentication (2FA), and vendor or partner onboarding. The primary focus of these Terms is to ensure that account verification is conducted securely, transparently, and in compliance with applicable laws. - Masking or misrepresenting the true nature or ownership of the Client’s identity or activities, including attempts to bypass regulatory requirements.
Clients must observe rate limits, quotas, and service-level expectations defined in this document or in a separate agreement. The use of the Service in the Netherlands must align with local consumer protection, data protection, and financial services regulations where applicable. Megapersonal reserves the right to suspend or terminate access for violations or suspected abuse, with reasonable notice and an opportunity to cure where feasible.
6. Data Security, Access, and Incident Response
Megapersonal employs multi-layer security controls, including multi-factor authentication for management interfaces, encryption of data in transit and at rest, and regular security assessments. Access to the Service is restricted to authorized personnel and Clients through role-based access controls. In the event of a data breach or suspected incident, Megapersonal follows a defined incident response plan, including notification to affected Clients when legally required and within regulatory timeframes. Clients are responsible for safeguarding their API credentials, webhook configurations, and secret keys. Clients retain ownership of data they submit to the Service. Megapersonal does not claim ownership over Client data. Upon termination of the Service or at Client request, Megapersonal will provide reasonable data export options and deletion processes in accordance with applicable law and the terms of the DPA. Retention periods will be defined in the DPA and may vary based on regulatory requirements or business needs. Where legally mandated, Megapersonal will assist with data deletion, ensuring restoration of a clean state within the defined retention window.
8. Service Levels, Availability, and Support
Megapersonal aims to provide high availability for the Service, with target uptimes published in accompanying SLAs or the subscription agreement. Delivery latency, message throughput, and success rates may vary depending on network conditions, mobile carrier routes, and regional regulatory constraints. Clients will receive status updates via the dashboard, API callbacks, and optional webhook notifications. Technical support is available through designated channels, with response times defined by the support plan selected by the Client. For critical outages, Megapersonal implements an incident communication protocol to keep Clients informed and supported during remediation.
9. Billing, Payment, and Taxes
Billing is based on usage metrics such as SMS messages delivered, verified accounts, and any additional services requested by the Client. All pricing, invoicing, and payment terms are documented in the service agreement or quote. Taxes, including VAT where applicable, are calculated and added according to Dutch and EU tax rules. Clients may incur overage charges if usage exceeds limits set in the plan. Invoices are issued electronically and payment terms are defined in the agreement. Any disputes about charges must be raised within the period specified in the invoice terms.
10. Term, Termination, and Suspension
These Terms remain in force for the duration of the Client’s subscription unless terminated in accordance with the agreement. 12. Governing Law and Disputes
These Terms, and any disputes arising out of or in connection with them, are governed by and construed in accordance with the laws of the Netherlands. Any unresolved disputes shall be submitted to the exclusive jurisdiction of the courts located in the Netherlands, unless mandatory arbitration or alternative dispute resolution is required by applicable law. The Client acknowledges that the Service involves cross-border data flows within the EU and complies with cross-border data transfer requirements under GDPR.
13. Changes to the Terms

The Client agrees to provide accurate information and to maintain up-to-date contact data for notices and communications related to the Service.
